License Agreement

monsterDSP Software License Agreement

This License Agreement ("Agreement") is a legal agreement between you (either an individual or a single entity) and monsterDSP for the software product identified above, which includes computer software and may include associated media, printed materials, and "online" or electronic documentation ("Software Product").

1. Grant of License

Subject to the terms and conditions of this Agreement, monsterDSP grants you a non-exclusive, non-transferable license to use the Software Product on a single computer or workstation for which the Software Product was designed.

2. Restrictions

You may not: (a) copy, modify, adapt, alter, translate, or create derivative works of the Software Product; (b) reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Software Product; (c) rent, lease, or lend the Software Product; (d) transfer your rights under this Agreement to any third party.

3. Ownership

The Software Product is owned by monsterDSP and is protected by copyright laws and international treaty provisions. This Agreement grants you only the right to use the Software Product and does not grant you any ownership rights in the Software Product.

4. Termination

This Agreement will terminate automatically if you fail to comply with the limitations described in this Agreement. On termination, you must destroy all copies of the Software Product.

5. Disclaimer of Warranties

THE SOFTWARE PRODUCT IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. monsterDSP DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

6. Limitation of Liability

IN NO EVENT SHALL monsterDSP BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE PRODUCT.

7. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which monsterDSP is located.
